PALISA – Mbale High Court has ordered city lawyer Silver Adowa, a son of the late engineer George William Owaraga to stop destroying his sister’s gardens in Pallisa. Inspector General of Police’s letter dated 14th June 2024 to enforce the court order told Adowa to keep away from Norah Owaraga’s property.
Police Legal Officer, North Bukedi, John Were led a team to the late Owaraga’s home, in Kadoki Village in Pallisa District to enforce the legal directive issued the order, on 4th May 2023.
“A temporary injunction is at this moment issued maintaining the status quo and restraining the respondent, his agents or assignees and successors from cutting and or destroying the applicant’ orchard trees until the determination of the main suit,” Lady Justice Apiny ruled.
In his affidavit, Adowa, acknowledged Norah’s use rights.
“It is the applicant who is in occupation of the suit land and some other family members other than the respondent,” he wrote.
Norah through Okalang Law Chambers, represented by Allan Ogoi as lead counsel, in March 2022, sued Adowa for allegedly destroying her orchard garden. The accused is reported to have encroached on her sister’s garden forcefully to cultivate using ox-ploughs for maize.
She requested the Court to order Adowa to pay her over Shs225 million in damages, loss of income, and interest of 27 percent per annum.
Norah established her orchard 15 years ago on land her late father gifted her. The land surrounds her father’s ancestral home in Pallisa district.
Adowa has also reportedly in the past attempted to take possession of their family
home where Norah resides in Entebbe.
